Genemarkers Notice of HIPAA Privacy Practices

Genemarkers is committed to protecting your private health information. We use a variety of industry-standard technical, physical and administrative procedures to safeguard your information. This Notice describes our privacy practices, as well as your rights with respect to Protected Health Information. We are required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) to protect the privacy of your protected health information and to notify you of any breach of your protected health information. Genemarkers will not share your personal information with any third parties without your permission, except as provided in this Policy Statement.

What is Protected Health Information?

Protected Health Information includes your name and date of birth, medical history, laboratory results, insurance information and other health information we collect, generate, use and share to produce genetic testing results, bill for our testing services, and for other purposes allowed or required by law.

We may use or share your protected health information in the following ways without your written authorization as permitted by law:

  • For treatment: we may use or disclose your protected health information to health care providers for treatment purposes. We may disclose your protected health information to physicians, nurses, medical assistants, pharmacists and others who are involved with your health care. This may include releasing laboratory test results to your physician or others involved in the coordination of your care.
  • For payment: we may use and disclose your protected health information to bill and collect payment for laboratory services that Genemarkers provides. We may also use and disclose your protected health information to determine eligibility and coverage.
  • For health care operations: we may use and disclose your protected health information for health care operations. These activities may include laboratory testing quality assessment and improvement, training and competency assessment of laboratory personnel, performing accreditation, certification and licensing activities, and other administrative functions. For example, we may use your protected health information to evaluate our customer service.
  • For research purposes: we may de-identify your protected health information and use for research or data mining purposes. De-identified data will not contain your name, address or any other information that can be used to identify you.
  • Authorized persons: we may share your protected health information with your family, friends or others who you have designated for health care support or for payment of services.
  • Business Associates: we may disclose your protected health information to contractors, agents and other business associates who need the information to help us with billing or other business activities related to the services we provide. We will disclose the minimum amount of information necessary to perform the business activity.
  • Public health activities: we may disclose your protected health information when we are required to report vital statistics to public health authorities.
  • Health & safety: we may share your protected health information to prevent or reduce the risk of a serious or imminent threat to the health and safety of an individual or the general public.
  • Law Enforcement: we may share your protected health information with the police or other law enforcement officials as required by law or in compliance with a court order, warrant subpoena, summons or other legal process.
  • Report Suspected Abuse, Neglect or Violence: we may share your protected health information with a government agency, if we reasonably believe that an adult or child is the victim of abuse, neglect or domestic violence.
  • Marketing: we may contact you to inform you of other Genemarkers services that we believe may be of interest to you.
  • Worker’s Compensation: we may disclose your protected health information for Worker’s Compensation or similar programs that provide benefits for work-related injuries, as necessary to comply with laws regarding Worker’s Compensation.

We will ask for your written authorization before using or sharing your protected health information for any purpose not described above.

Your rights regarding access and control of your protected health information:

  • You may request an electronic or paper copy of your medical records. The request will be completed within 30 days. There may be a reasonable fee for this service.
  • You have the right to receive a notice that describes how your protected health information may be used and shared.
  • You have the right to request that Genemarkers limit the use of your protected health information for treatment, payment or health care operations. Genemarkers will consider the request, but is not required to agree to it.
  • You have the right to request corrections or updates to your protected health information.
  • You have the right to request that your protected health information not be shared with certain individuals, groups or companies.
  • You have the right to request that Genemarkers communicate with you through an alternative address or means. For example, through your office or by mail.
  • You have the right to contact Genemarkers if you have questions, would like to exercise any of your rights, or file a complaint.

If you have questions or comments, or would like to report a problem regarding the handling of your protected health information, you may contact our Privacy Officer by using the contact information provided below. You may also file a complaint with the Secretary of Health & Human Services (HHS). We will provide you with the address to report a complaint upon request. Genemarkers will not retaliate against you for filing a complaint against Genemarkers privacy practices.

Genemarkers may make changes to this notice from time to time. When changes are made,
Genemarkers will promptly update this policy. Policy changes will be maintained on the company
website.
